Independent living in New York is typically unlicensed housing, since no personal care is provided. Assisted living requires an Adult Care Facility base license (Adult Home, Enriched Housing Program, or Residence for Adults) plus, usually, Assisted Living Residence (ALR) certification from NYSDOH under 10 NYCRR Part 1001.
The practical dividing line
If a Long Island community only provides an apartment, meals, housekeeping and activities, with no help with bathing, dressing or medication management, it is very likely independent living and unlicensed as a care facility. The moment personal care support is added, New York generally requires ACF/ALR licensure.
Several Long Island campuses -- Jefferson's Ferry (South Setauket) and Peconic Landing (Greenport) among them -- combine independent living with assisted living, memory care and nursing on one site through a Life Plan Community (CCRC) model, letting a resident move between levels without changing communities.
